MingleMinds Terms of Service

Welcome to MingleMinds.

These Terms of Service (“Terms”) govern your access to and use of the MingleMinds mobile application, Apple TV companion application, website features where applicable, and related services collectively referred to as the “Service.”

The Service is operated by MingleMinds LLC (“MingleMinds,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Trust & Safety Policy.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use MingleMinds.

By creating an account or using the Service, you represent that:

• you are at least 18 years old;
• the information you provide regarding your age is accurate;
• you are legally capable of entering into these Terms; and
• your use of MingleMinds does not violate applicable law.

MingleMinds requires users to provide information indicating that they meet the minimum age requirement. However, MingleMinds does not represent that it independently verifies every member’s age or identity through government-issued identification.

A person’s presence on MingleMinds should not be interpreted as confirmation that MingleMinds has independently verified that person’s age, identity, background, or other profile information.

If MingleMinds determines that an account belongs to someone under 18, that account may be permanently removed.

Providing false information regarding your age is a violation of these Terms.

2. Account Registration

At launch, MingleMinds account registration is available through Sign in with Apple.

MingleMinds does not offer username-and-password or telephone-number account registration at launch.

You agree to:

• provide accurate, current, and complete information during registration and onboarding;
• maintain only one active MingleMinds account unless MingleMinds expressly authorizes otherwise;
• not impersonate another person;
• not materially misrepresent your identity, age, gender, physical appearance, or other information presented to other members;
• maintain control of the Apple account used to access MingleMinds;
• not knowingly allow another person to operate your MingleMinds account as their own; and
• notify MingleMinds if you believe your account has been compromised or accessed without authorization.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

MingleMinds may use account, device, authentication, and other appropriate information to protect account integrity, investigate suspected abuse, and enforce permanent removals.

3. Account Deletion

You may delete your MingleMinds account through the account-deletion functionality provided within the Service.

When you delete your account:

• your active profile is removed from the normal member experience;
• your matches may be dissolved;
• other members may lose access to conversations or relationships associated with your account; and
• MingleMinds will process deletion and retention in accordance with our Privacy Policy.

Account deletion does not necessarily result in the immediate deletion of every record associated with the account.

MingleMinds may retain information where reasonably necessary for purposes including:

• Trust & Safety investigations;
• preservation of reports and supporting evidence;
• fraud prevention;
• enforcement of permanent account removals;
• preventing ban evasion;
• security and abuse prevention;
• resolving disputes;
• compliance with legal obligations;
• responding to lawful legal process; or
• other purposes permitted by our Privacy Policy and applicable law.

Information retained for these purposes may remain after the member-facing account has been deleted.

4. Service Overview

MingleMinds is a dating platform designed around intentional, paced profile discovery rather than unlimited profile consumption.

The Service may include the following experiences.

Discovery

Discovery allows you to view profiles of other members who are eligible to appear based on MingleMinds product rules.

Users may receive up to 10 profiles during a daily Discovery availability period.

Profile eligibility may depend on factors including:

• preferences selected by members;
• geographic availability;
• account eligibility;
• existing Blocks;
• match capacity;
• safety controls;
• product availability;
• service-area availability; and
• other MingleMinds product rules.

MingleMinds does not guarantee that every member who could potentially satisfy your preferences will be shown to you.

MingleMinds also does not guarantee that profiles will appear in any particular order.

Waiting Room

The Waiting Room contains mutual matches that have not been moved into Active Chat.

Waiting Room matches generally expire after 5 days if they are not moved into Active Chat.

When a match expires, the match is dissolved and may not be recoverable.

Active Chat

Active Chat is designed to limit simultaneous conversations.

A member may have a maximum of 2 Active Chats at one time.

If both Active Chat positions are occupied, the member must make room before beginning another Active Chat.

Where supported by the product, moving a person out of Active Chat may return that match to the Waiting Room and subject it to the applicable Waiting Room expiration rules.

Messages

MingleMinds allows members with appropriate match status to exchange text communications through the Service.

MingleMinds does not guarantee permanent or indefinite storage of message history.

Messages are not ordinarily monitored in real time, but they may be reviewed where reasonably necessary for a Trust & Safety investigation, fraud investigation, legal requirement, or other authorized operational purpose.

5. Service Area

MingleMinds may initially be available only in selected geographic areas.

Access to Discovery, profile creation, matching, or other functionality may depend on whether you are located within an active MingleMinds service area.

MingleMinds may expand, reduce, modify, or otherwise change supported geographic areas.

Availability in one location does not guarantee continued availability there.

MingleMinds does not guarantee that sufficient numbers of eligible members will be available in every supported geography.

6. Profile Requirements

To use the full dating experience, you must complete the required MingleMinds onboarding process.

Required profile information may include:

• your first name;
• date of birth;
• gender and dating preferences;
• relationship preferences;
• family and children-related information;
• education or employment information;
• lifestyle information;
• profile photographs;
• biography information; and
• profile prompts or other information used to create your member profile.

The specific required fields may evolve as the Service changes.

You agree that information presented to other members will not intentionally or materially misrepresent who you are.

MingleMinds may require a minimum number of acceptable profile photographs or other profile information before allowing access to Discovery.

Profile content is subject to MingleMinds moderation systems and policies.

Certain profile fields may not be editable after onboarding or may require additional steps to change. Any such restrictions will be disclosed through the Service where applicable.

7. Profile Visibility

MingleMinds may provide controls allowing members to hide or limit visibility of certain profile information.

Other information necessary to operate the dating experience may remain visible.

Information displayed to another user may include profile information such as:

• name;
• age;
• photographs;
• biography;
• prompt responses;
• relationship intentions;
• approximate distance; and
• other information the member has made available through the Service.

MingleMinds does not intentionally display your precise geographic coordinates to other members.

Some profile information may also appear through Lounge Mode and the MingleMinds Apple TV experience as described below.

8. Match Mechanics and Limits

MingleMinds intentionally limits match and conversation capacity.

Total Match Limit

A member may have a maximum of 5 simultaneous matches, including Waiting Room and Active Chat matches combined.

Visibility at Match Capacity

When a member reaches the maximum match capacity, MingleMinds may temporarily stop displaying that member to other users for new matching opportunities.

Existing matches and conversations are not necessarily affected.

Waiting Room Expiration

Waiting Room matches generally expire after 5 days if they are not moved into Active Chat.

An expired match may be permanently dissolved.

Active Chat Limit

Members may have a maximum of 2 simultaneous Active Chats.

Match Slot Recovery

When a match is dissolved through expiration, Block, account deletion, or another supported product action, the occupied match capacity may become available again.

MingleMinds may modify match mechanics as the Service evolves, provided that material changes affecting paid entitlements, if any are introduced in the future, will be handled in accordance with applicable purchase terms and law.

9. Lounge Mode and the Apple TV Companion

MingleMinds includes an Apple TV companion experience designed to extend portions of the mobile dating experience to a shared television environment.

This experience may be referred to as Lounge Mode.

Lounge Mode may allow an authenticated MingleMinds member to connect or pair a supported mobile device with a supported Apple TV device and use the mobile device to control experiences displayed on the television.

Lounge Mode may display:

• profile photographs;
• profile information;
• profile prompt responses;
• match-related information;
• profile comparison experiences;
• other dating-related content otherwise available within MingleMinds; and
• controls or information necessary to operate the TV experience.

The availability of specific Lounge Mode features may vary.

Shared Viewing

Lounge Mode is intentionally designed for an environment in which other people may be physically present with the MingleMinds member using the television.

By creating and maintaining a MingleMinds profile, you understand that content you make available through the Service may be displayed to another eligible MingleMinds member through both mobile and supported television interfaces.

You also understand that when your profile is displayed through Lounge Mode, people physically present with that member may be able to see your profile content on the television.

Those people are not necessarily MingleMinds account holders.

MingleMinds does not select, verify, or control the people another member chooses to have physically present while using Lounge Mode.

Responsibility for the Viewing Environment

The MingleMinds member who initiates Lounge Mode is responsible for choosing the physical environment in which the TV experience is displayed.

Members should use reasonable judgment regarding who is present when private or sensitive dating-related information is displayed.

Permitted Use of Other Members’ Profiles on TV

Profile content displayed through Lounge Mode is provided solely as part of the personal MingleMinds dating experience.

Access to another member’s profile does not grant you ownership of that person’s content.

You may not use Lounge Mode or another MingleMinds feature to:

• publicly exhibit another member’s profile outside the intended personal dating experience;
• rebroadcast or livestream another member’s profile;
• commercially exploit another member’s name, likeness, photographs, biography, or profile content;
• scrape, collect, archive, or build databases of member profiles;
• distribute profile content for harassment, humiliation, intimidation, discrimination, or retaliation;
• use profile information to dox or expose another member’s private identifying information;
• falsely imply that another member endorses you, your business, or another product;
• modify another person’s profile content in a misleading or harmful manner;
• use another member’s content to create deceptive or abusive derivative material; or
• redistribute another member’s content outside MingleMinds in violation of these Terms, our Trust & Safety Policy, applicable law, or the member’s rights.

Nothing in these Terms gives you a license to commercially exploit another member’s identity or content.

TV Availability

Use of Lounge Mode may require:

• compatible Apple hardware;
• compatible software versions;
• internet access;
• an active MingleMinds account;
• successful device pairing; and
• feature availability for your account.

MingleMinds does not guarantee uninterrupted compatibility with every television, mobile device, operating-system version, or network configuration.

10. Blocking Another Member

Blocking is a user-control feature.

You may Block another member without proving that the person violated these Terms or any MingleMinds policy.

A member may Block someone simply because they do not want that person to appear in their MingleMinds experience.

When a Block is successfully completed:

• the Block is permanent;
• MingleMinds does not currently provide an unblock function;
• the two accounts should no longer be eligible to communicate with or be surfaced to one another through MingleMinds;
• an existing match may be dissolved;
• the blocked member will not ordinarily be told who specifically blocked them; and
• the Block itself does not establish that the blocked person committed misconduct.

A Block does not automatically create a Trust & Safety Report.

11. Reporting Another Member

Reporting is different from Blocking.

A Report asks MingleMinds to review conduct that the reporting member believes may violate these Terms, the MingleMinds Trust & Safety Policy, or applicable law.

A member submitting an in-product Report must:

• select an available Report reason; and
• provide written context explaining what happened and why the person is being reported.

MingleMinds requires written context because the circumstances surrounding a Report matter.

A Report cannot be submitted through the normal in-product reporting process based solely on selecting a category without providing the required explanation.

Available categories may include:

• harassment, abusive, or sexual behavior;
• threats or safety concerns;
• fake profiles or impersonation;
• spam, scams, or solicitation;
• conduct outside MingleMinds; or
• other conduct appropriate for review.

Reporting Automatically Blocks

Every successful Report automatically invokes MingleMinds’ permanent Block functionality between the reporting and reported accounts.

The reporting member is not required to make a separate Block decision after submitting the Report.

After successful submission:

• the reported member is removed from the reporting member’s MingleMinds experience;
• the two accounts become permanently blocked from one another through MingleMinds;
• the existing Block rules apply; and
• the reporting member receives confirmation that MingleMinds received the Report.

Every successful Report results in a permanent Block. Not every Block results in a Report.

Submitting a Report does not itself establish that the reported member violated these Terms.

A Report is an allegation requiring review.

The reported member is not automatically permanently removed from MingleMinds merely because another member submitted a Report.

Additional information about reporting and enforcement is available in the MingleMinds Trust & Safety Policy.

12. Information Reviewed During a Report

When a Report is submitted, MingleMinds may review information reasonably necessary to understand and investigate the allegations.

This may include:

• the reporting account;
• the reported account;
• profile information;
• photographs and profile content;
• internal account identifiers;
• the selected Report reason;
• the written explanation submitted by the reporting member;
• match status and match history;
• relevant messages exchanged between the members;
• message timestamps;
• relevant account activity;
• previous relevant Trust & Safety Reports;
• moderation or system signals; and
• other information reasonably necessary to review the matter.

Authorized MingleMinds personnel may access private MingleMinds conversations where reasonably necessary for an authorized Trust & Safety, security, fraud, legal, or related investigation.

Blocking, match dissolution, account deletion, or profile changes do not necessarily delete information associated with an existing Report.

MingleMinds may preserve relevant evidence in accordance with its Privacy Policy, Trust & Safety Policy, and applicable law.

13. User Conduct

You agree not to use MingleMinds to:

• violate applicable law or the rights of another person;
• threaten, harass, stalk, intimidate, abuse, or harm another member;
• engage in sexual coercion or nonconsensual sexual conduct;
• impersonate another person;
• materially misrepresent your identity or profile;
• engage in fraud or romantic scams;
• solicit money or sensitive financial information;
• send spam or repetitive unwanted communications;
• engage in extortion, blackmail, or sextortion;
• publish or distribute nonconsensual intimate material;
• dox another person;
• engage in hate-based abuse or targeted discriminatory harassment;
• create fake or duplicate accounts;
• use bots or automated systems to manipulate the Service;
• evade a permanent MingleMinds removal;
• scrape or systematically collect information from the Service;
• reverse engineer or attempt to obtain MingleMinds source code except where applicable law expressly permits;
• interfere with MingleMinds systems, infrastructure, security, or networks;
• exploit another member’s profile content outside the purposes permitted by these Terms;
• use AI-generated Opener content to deliberately misrepresent your identity or intentions; or
• use the Service in a manner that creates a serious safety threat or materially undermines the integrity of MingleMinds.

Additional safety rules appear in the MingleMinds Trust & Safety Policy.

14. Trust & Safety Enforcement

MingleMinds may investigate suspected violations of these Terms or the Trust & Safety Policy.

A Report does not automatically establish wrongdoing.

MingleMinds may consider the available evidence and circumstances before determining whether account-level enforcement is appropriate.

For serious Trust & Safety violations, MingleMinds’ standard enforcement approach is:

• no platform-level enforcement where removal is not warranted; or
• permanent removal where MingleMinds determines the conduct is sufficiently serious to justify removal.

MingleMinds does not use a warning, temporary restriction, or temporary safety-suspension ladder as its standard Trust & Safety enforcement model.

Nothing in this section prevents MingleMinds from temporarily making an account or feature unavailable for technical, security, legal, authentication, App Store, or operational reasons unrelated to disciplinary Trust & Safety enforcement.

15. Permanent Removal and Ban Evasion

If MingleMinds permanently removes your account for a violation of these Terms, the Trust & Safety Policy, fraud, abuse, or another serious reason, the removal is intended to be permanent.

A permanently removed user may not create, operate, or access another MingleMinds account unless MingleMinds expressly authorizes otherwise.

Attempts to evade permanent removal may include using:

• another Apple account;
• another email address;
• another device;
• another profile;
• another identity;
• another person’s account; or
• any other method intended to circumvent the removal.

MingleMinds may remove replacement accounts or take other measures reasonably necessary to enforce a permanent removal.

16. Safety Disclaimer

MingleMinds does not conduct criminal background checks on every member.

MingleMinds does not represent that it independently verifies every member’s identity or age using government-issued identification.

A profile appearing on MingleMinds is not an endorsement or guarantee of that person’s:

• identity;
• honesty;
• background;
• character;
• intentions;
• behavior; or
• safety.

You are responsible for exercising judgment when communicating with or meeting someone through MingleMinds.

No matching system, moderation process, safety feature, report, block, or technical tool can eliminate every risk associated with meeting another person.

Additional safety information is provided in the MingleMinds Trust & Safety Policy.

17. Content Moderation

MingleMinds uses automated and AI-assisted systems to review certain user-submitted profile content.

Moderated content may include:

• display names;
• profile text;
• biographies;
• prompt responses;
• profile photographs; and
• other content submitted for inclusion in a profile.

Moderation systems may evaluate content for categories including:

• sexual content;
• child-safety concerns;
• hate or discriminatory content;
• harassment;
• threats;
• violence;
• fraud or illicit activity;
• toxic or abusive content; and
• other material inconsistent with MingleMinds policies.

Content may be rejected, prevented from publication, or removed where MingleMinds determines it violates applicable requirements.

Automated moderation systems may make mistakes.

MingleMinds does not guarantee that moderation will detect every violation.

MingleMinds may conduct human review where necessary, including in connection with a Report, Trust & Safety investigation, suspected fraud, security incident, or legal obligation.

Private chat messages are not ordinarily subjected to continuous real-time human monitoring, but may be reviewed in authorized investigation contexts.

18. The Opener

MingleMinds offers The Opener, an optional AI-generated suggested first-message feature.

At launch, The Opener is available to eligible members who selected Man as their gender during onboarding.

Eligibility may change as the Service evolves.

Complimentary Openers

Eligible male users receive 2 complimentary Openers upon account creation.

Complimentary Openers:

• are provided as a one-time account benefit;
• have no cash value;
• are non-transferable; and
• may not be exchanged for money or another benefit.

After complimentary Openers have been used, additional Openers may be available for purchase as consumable in-app purchases.

AI Provider

The Opener may rely on a third-party artificial-intelligence provider to generate suggestions based on information made available through the relevant MingleMinds interaction.

AI-generated suggestions may be inaccurate, inappropriate, incomplete, or otherwise unsuitable.

Your Responsibility

The Opener is optional.

You are responsible for reviewing any generated suggestion before deciding whether to use or send it.

MingleMinds does not send the suggested message on your behalf without the applicable user action.

You remain responsible for messages you choose to send, including messages originally generated or assisted by The Opener.

You may not use The Opener to intentionally deceive another member or materially misrepresent your identity.

19. Consumable Purchases

MingleMinds may offer consumable in-app purchases through the Apple App Store.

Consumables may include:

• additional Openers;
• Swaps; and
• other consumable items introduced by MingleMinds.

Consumables are different from subscriptions.

A consumable generally provides a limited number of uses or a one-time product benefit.

The applicable quantity, price, and product description will be displayed before purchase.

MingleMinds does not guarantee that a consumable offered at one time will remain available indefinitely.

Openers

A purchased Opener is consumed when the applicable AI-assisted generation is performed according to the product rules presented in the Service.

Because generation may involve an external AI provider and associated processing cost, complimentary promotional access to other MingleMinds features does not automatically include unlimited free Openers.

Swaps

Swaps may allow an eligible member to replace or refresh profile availability according to the product rules displayed at the time of use.

A Swap is consumed when successfully used.

Apple Billing

Purchases made through the Apple App Store are processed by Apple.

MingleMinds does not receive or store your complete App Store payment-card information.

Refund eligibility for purchases processed by Apple is subject to Apple’s applicable policies and legal requirements.

20. Mingle Marketplace and Launch Month

MingleMinds may make certain enhanced product features available through the Mingle Marketplace.

Launch Month

For purposes of these Terms, “Launch Month” means the first 30 consecutive days beginning on the date MingleMinds becomes publicly available through the Apple App Store.

During Launch Month, MingleMinds intends to make the Mingle Marketplace and features that may later become paid subscription features available to users at no charge.

Launch Month access:

• does not require the user to enroll in a subscription;
• does not require a credit card or other payment method to be provided to MingleMinds;
• is not an auto-renewable subscription;
• is not a subscription free trial;
• does not automatically convert to paid access when Launch Month ends; and
• does not create an obligation to purchase those features later.

Consumables such as paid Openers and Swaps are separate from Launch Month Marketplace access unless MingleMinds expressly states otherwise.

21. Future Paid Features and Subscriptions

As of the effective date of these Terms, MingleMinds does not offer an enabled paid subscription program.

MingleMinds may introduce paid subscriptions or other paid feature access in the future.

Before a paid subscription becomes available, MingleMinds will display the applicable:

• price;
• billing period;
• included features;
• renewal terms;
• cancellation information; and
• other material purchase terms.

MingleMinds may also update these Terms or provide supplemental terms when subscriptions are introduced.

No user’s current free access should be interpreted as a promise that a feature will remain free indefinitely.

Similarly, a feature that MingleMinds expects to charge for in the future is not a subscription until a user actually enters into a paid subscription transaction.

22. Deleting an Account While Subscribed in the Future

If MingleMinds later introduces an auto-renewing subscription processed through the Apple App Store, deleting your MingleMinds account will not necessarily cancel the subscription maintained through Apple.

A user with an active App Store subscription will need to manage or cancel that subscription through the applicable Apple subscription-management process.

MingleMinds will provide appropriate information regarding subscription cancellation if and when subscriptions are introduced.

This section does not mean that paid subscriptions are currently available.

23. Feature Availability and Eligibility

Not every MingleMinds feature is necessarily available to every user.

Feature eligibility may depend on factors including:

• gender selected during onboarding;
• product surface;
• mobile or TV platform;
• geographic market;
• account status;
• match state;
• Marketplace availability;
• supported device;
• feature rollout;
• testing or beta participation;
• safety or account eligibility; or
• other product requirements disclosed through the Service.

For example, The Opener may be available only to eligible male users.

A feature’s availability to one member does not guarantee its availability to another.

MingleMinds may add, modify, discontinue, or replace features as the Service evolves.

Where MingleMinds later charges for access to a particular feature or entitlement, material changes will be subject to applicable purchase terms, law, and App Store requirements.

24. Data Availability and Message Retention

MingleMinds does not guarantee permanent or indefinite availability of every match, message, profile, interaction record, or other user-facing item.

For example:

• Waiting Room matches may expire;
• matches may be dissolved;
• users may delete accounts;
• members may Block one another;
• Reports may cause members to be permanently blocked from one another; and
• MingleMinds may remove accounts or content under these Terms.

When another member deletes their account, their profile, match relationship, or conversation may no longer remain visible to you.

When you delete your account, your active relationships may be removed from the other member-facing experience.

MingleMinds may maintain ordinary retention periods for messages and account information as described in the Privacy Policy.

However, ordinary deletion periods do not necessarily apply to information that MingleMinds is permitted or required to preserve for:

• Trust & Safety Reports;
• supporting evidence;
• fraud investigations;
• permanent-removal enforcement;
• ban-evasion prevention;
• disputes;
• security investigations;
• legal holds;
• regulatory requirements; or
• lawful legal process.

MingleMinds does not guarantee recovery of deleted, expired, dissolved, or otherwise unavailable user-facing data.

25. User Content

You retain ownership of content you submit to MingleMinds, subject to the licenses necessary for MingleMinds to operate the Service.

User Content may include:

• profile photographs;
• profile text;
• biographies;
• prompts;
• audio content;
• messages; and
• other material you submit through MingleMinds.

By submitting User Content, you grant MingleMinds a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, reproduce, display, transmit, adapt where technically necessary, and otherwise use that content for purposes including:

• operating the Service;
• displaying your profile to eligible members;
• displaying eligible profile content through mobile and television experiences;
• providing Lounge Mode;
• providing matching and messaging functionality;
• moderating content;
• investigating Reports or abuse;
• providing support;
• maintaining security;
• preventing fraud;
• complying with legal obligations; and
• improving MingleMinds.

This license is limited to purposes related to operating, protecting, supporting, and improving the Service and exercising MingleMinds’ rights and obligations under these Terms.

Deletion of content or your account may terminate ordinary Service use of that content, subject to information MingleMinds is permitted or required to retain.

26. Notifications

MingleMinds may provide:

• push notifications;
• in-app alerts;
• banners;
• account notices;
• match notifications;
• message notifications;
• safety notifications;
• purchase-related notices; and
• other communications associated with the Service.

You may control certain push notifications using MingleMinds settings or Apple device settings where available.

Certain essential account, safety, legal, or transactional notices may not be optional.

27. Analytics and Service Measurement

MingleMinds may use analytics and measurement providers, including tools such as Mixpanel where used, to understand:

• feature usage;
• engagement;
• application performance;
• product reliability;
• conversion and purchase behavior;
• unusual or abusive activity; and
• other operational information.

Analytics practices are further described in the MingleMinds Privacy Policy.

28. Account Inactivity

MingleMinds may deactivate or remove accounts that have remained inactive for an extended period.

Where reasonably practicable, MingleMinds may provide notice before inactivity-based account removal.

MingleMinds is not responsible for loss of expired matches or other Service data resulting from prolonged inactivity, subject to applicable law.

29. Termination of Access

MingleMinds may permanently disable or remove an account where appropriate if:

• the user materially violates these Terms;
• the user commits a serious violation of the Trust & Safety Policy;
• the account is used for fraud or abuse;
• the user attempts to evade a permanent removal;
• the account presents a serious threat to another member or the Service;
• removal is required by law, court order, valid legal process, or applicable platform requirements; or
• another basis for permanent removal exists under these Terms.

Permanent removal may result in loss of:

• access to MingleMinds;
• matches;
• messages;
• Marketplace access;
• unused complimentary benefits; and
• unused consumables, subject to applicable law and App Store requirements.

A permanently removed user may not create a replacement account without MingleMinds’ express authorization.

MingleMinds may also temporarily make the Service inaccessible for maintenance, security, authentication, legal, technical, or operational reasons. Such temporary unavailability is not necessarily a disciplinary suspension.

30. Apple App Store and Apple Devices

The MingleMinds iOS and tvOS applications are distributed through the Apple App Store.

Your use of MingleMinds on Apple devices is also subject to applicable Apple terms and usage rules.

Agreement Between You and MingleMinds

These Terms are between you and MingleMinds LLC, not Apple Inc.

MingleMinds, not Apple, is responsible for the MingleMinds application and the Service, except to the extent Apple has independent obligations under applicable law or its own agreements.

License

Subject to these Terms, MingleMinds grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the MingleMinds application on Apple-branded products that you own or control, as permitted by Apple’s applicable usage rules.

Maintenance and Support

MingleMinds is responsible for providing maintenance and support for the MingleMinds Service to the extent required under these Terms or applicable law.

Apple has no obligation to provide maintenance or support for MingleMinds.

Warranty

To the extent any warranty exists under applicable law and MingleMinds fails to satisfy that warranty, you may have rights available through Apple or MingleMinds as required by applicable law and Apple’s policies.

Except where required by law, Apple has no warranty obligation regarding MingleMinds.

Product Claims

MingleMinds, rather than Apple, is responsible for addressing claims relating to the MingleMinds application or your possession or use of it, including claims involving:

• product liability;
• legal or regulatory compliance;
• consumer-protection requirements; and
• privacy or similar claims,

to the extent applicable.

Intellectual Property Claims

If a third party claims that MingleMinds or your authorized use of the application infringes that third party’s intellectual-property rights, MingleMinds, rather than Apple, is responsible for addressing the claim to the extent required by applicable law.

Legal Compliance

You represent that you are not located in a country subject to a United States government embargo and that you are not listed on a United States government list of prohibited or restricted parties, except where applicable law prevents such representation.

Third-Party Terms

You must comply with applicable third-party terms when using MingleMinds, including terms associated with Apple services, your network provider, and other services you choose to use with MingleMinds.

Apple as Third-Party Beneficiary

Apple and its subsidiaries are intended third-party beneficiaries of the portions of these Terms applicable to the Apple-distributed MingleMinds applications.

Upon your acceptance of these Terms, Apple may have the right to enforce those applicable provisions against you as a third-party beneficiary.

31. Third-Party Services

MingleMinds may rely on third parties for services including:

• cloud infrastructure;
• authentication;
• AI generation;
• analytics;
• payment processing;
• moderation infrastructure;
• communications;
• Apple platform functionality; and
• other technical services.

MingleMinds is not responsible for independent acts or omissions of third-party providers outside MingleMinds’ reasonable control.

Your use of third-party services may also be subject to those providers’ applicable terms.

32. Beta or Experimental Features

MingleMinds may offer features that are experimental, limited, in testing, or otherwise subject to change.

Beta or experimental features may:

• contain errors;
• behave unexpectedly;
• be available only to certain users;
• change substantially; or
• be discontinued.

Unless otherwise expressly stated, use of beta features is at your own risk.

33. Disclaimers

To the fullest extent permitted by law, MingleMinds provides the Service on an “as is” and “as available” basis.

MingleMinds does not guarantee:

• that you will find a match, relationship, or particular romantic outcome;
• that another member is who they claim to be;
• that profile information provided by another member is accurate;
• that another member will behave safely, lawfully, honestly, or respectfully;
• that every harmful user or item of content will be detected;
• that every Report will result in account-level enforcement;
• that every allegation can be independently verified;
• that automated moderation will always be accurate;
• that an AI-generated Opener will be appropriate, effective, or accurate;
• that Lounge Mode will be compatible with every device or environment;
• that the Service will always be uninterrupted or error-free; or
• that every feature will remain available indefinitely.

To the fullest extent permitted by applicable law, MingleMinds disclaims implied warranties including merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms excludes rights that cannot legally be excluded.

34. Interactions With Other Members

Your decisions regarding whether and how to interact with another member are your responsibility.

MingleMinds does not supervise:

• private relationships;
• in-person dates;
• off-platform text conversations;
• telephone or video communications;
• social-media interactions; or
• other conduct occurring outside MingleMinds.

MingleMinds may review off-platform conduct when reported and when information reasonably available to MingleMinds supports review under the Trust & Safety Policy.

An unverified allegation about conduct occurring entirely outside MingleMinds does not, standing alone, automatically establish grounds for permanent account removal.

Submitting a Report nevertheless automatically Blocks the reported member from the reporting member’s MingleMinds experience.

35. Limitation of Liability

To the fullest extent permitted by applicable law, MingleMinds LLC and its officers, managers, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

• your use of or inability to use the Service;
• interactions, communications, relationships, or meetings with other users;
• conduct occurring outside the Service;
• loss of matches, messages, content, data, or consumable purchases;
• interruption or discontinuation of features;
• unauthorized access to or alteration of your account;
• reliance on AI-generated content;
• use of Lounge Mode or shared television viewing;
• third-party services; or
• another matter relating to the Service.

To the fullest extent permitted by applicable law, MingleMinds’ total cumulative liability for claims arising out of or relating to the Service or these Terms will not exceed the greater of:

1. the total amount you paid to MingleMinds during the 12 months preceding the event giving rise to the claim; or
2. $100 USD.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

36. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MingleMinds LLC and its officers, managers, employees, contractors, agents, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:

• your use of the Service;
• your violation of these Terms;
• content you submit or distribute;
• your misuse of another member’s profile or content;
• your violation of another person’s rights; or
• your violation of applicable law.

37. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered in accordance with the rules of a recognized arbitration body.

You and MingleMinds each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative proceeding.

Arbitration Opt-Out

If you do not wish to be bound by the arbitration agreement above, you must notify MingleMinds in writing within 30 days of the date you first accept these Terms.

Arbitration Opt-Out

Your election to opt out applies only to the arbitration provision and does not affect any other part of these Terms.

If you validly opt out, disputes will be resolved exclusively in the state or federal courts located in Dallas, Texas, and both parties consent to the personal jurisdiction of those courts.

38. Changes to the Service

MingleMinds is an evolving product.

We may introduce, modify, replace, restrict, or discontinue features.

We may also change:

• eligibility requirements;
• feature availability;
• Marketplace offerings;
• consumables;
• geographic availability;
• supported devices; or
• other aspects of the Service.

MingleMinds does not guarantee that a free feature will remain free indefinitely.

If MingleMinds later introduces paid subscription entitlements, material rights associated with those paid entitlements will be governed by the purchase terms presented at that time, applicable law, and applicable App Store requirements.

39. Modifications to These Terms

MingleMinds may update these Terms as the Service, business model, products, laws, or platform requirements evolve.

When required by applicable law, we will provide notice of material changes before they become effective.

Notice may be provided through:

• the Service;
• an in-app notice;
• email;
• push notification;
• the MingleMinds website; or
• another reasonable method.

Your continued use of the Service after revised Terms take effect constitutes acceptance of those Terms to the extent permitted by law.

If you do not agree to revised Terms, you must stop using the Service and may delete your account.

40. Relationship to Other MingleMinds Policies

These Terms should be read together with the MingleMinds:

• Privacy Policy; and
• Trust & Safety Policy.

The Privacy Policy explains how MingleMinds collects, uses, shares, retains, and protects information.

The Trust & Safety Policy provides additional information regarding:

• prohibited conduct;
• criminal-background-check disclosures;
• Blocking;
• Reporting;
• Report evidence;
• off-platform incidents;
• enforcement;
• permanent removal;
• safety resources; and
• state-specific dating-safety information.

If a conflict exists between a specific Trust & Safety rule and a more general provision of these Terms regarding safety enforcement, the more specific Trust & Safety rule should govern that safety matter to the extent permitted by law.

41. Severability and No Waiver

If any provision of these Terms is found unenforceable or invalid, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

MingleMinds’ failure to enforce a provision of these Terms does not waive its right to enforce that provision later.

42. Entire Agreement

These Terms, together with the Privacy Policy, Trust & Safety Policy, and any additional terms expressly presented for a particular MingleMinds feature or transaction, constitute the agreement governing your use of the Service.

They supersede prior terms concerning the same subject matter to the extent permitted by law.
